Sweepstakes Period/Sponsors: The “Hot Dog on a Stick Survey Sweepstakes” (the “Sweepstakes”) begins at 12:00:01 AM Eastern Daylight Time (“EDT”) on June 5, 2019 and ends at 11:59:59 PM EDT on June 11, 2019 (the “Sweepstakes Period”). The Sponsor is HDOS Brand and Marketing Fund, LLC, c/o GFG Management, LLC, 5555 Glenridge Connector Suite 850, Atlanta, GA 30342.
Eligibility: The Sweepstakes is intended for participation and viewing only to lawful permanent residents and citizens of the 50 United States and the District of Columbia who are 18 years of age or older on the date of entry, and shall be construed and evaluated according to United States law. To participate in the Sweepstakes, you must have Internet access. Employees, officers, directors, manager and members of Sponsor, GFG Management, LLC, and the respective parent company, affiliates and subsidiaries, advertising and promotion agencies and anyone working on the implementation or administration of the Sweepstakes or fulfillment of any prizes (“Sweepstakes Entities”), as well as the immediate family members (parents, children, siblings, spouses) and/or persons living in the same household (whether related or not) of each, are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. Void where prohibited by law.
How to Enter: To enter visit our Snack and Meal Brand Survey during the Sweepstakes Entry Period, and complete the Survey Form to be entered. The person named on the Survey Form will be deemed the entrant (“Entrant”). In the event of a dispute as to any entrant, Sponsor shall be entitled to assume that the person who’s name appears on the Survey Form, or if such person is a minor, that person’s parent or guardian, is the registrant or player. Entries must be submitted by an individual; no group entries allowed. Incomplete, unreadable, unintelligible or otherwise non-compliant Entries will be disqualified. Entries will not be acknowledged or returned. Proof of submission of an Entry does not constitute proof of receipt by Sponsor. There is a limit of 1 (one) Entry per person/email address. Additional Entries beyond the specified limit from any one person/email address will be void. Incomplete and inaccurate entries are void. By entering this Sweepstakes, each Entrant gives their express permission to be contacted by Administrator and/or Sponsor for Sweepstakes purposes only. The use of script, macro, automated entry or similar devices or other any other devices that subvert the entry process to participate is prohibited and all Entries through such devices are void. In the event of a dispute as to the identity of any entrant based on an email address, Entrant will be deemed to be the “authorized account holder” of the email address submitted at the time of entry provided he/she is eligible according to these Official Rules. “Authorized account holder” is defined as the natural person who is assigned to the email address by an Internet access provider, online service provider or other organization (e.g., a business, educational institution, etc.) which is responsible for assigning email addresses for the domain associated with the submitted email address. Proof (to Sponsor’s or Administrator’s satisfaction) of being the authorized account holder may be required. For the purposes of this Sweepstakes a Day starts at 12:00 A.M. EDT and ends at 11:59 P.M. EDT (each a “Day”). Sponsor’s computer is the official time keeping device for this Sweepstakes.
Daily Drawings: There will be 1 drawing to select one (1) winner from all entries received during the Sweepstakes Period (the “Prize Drawing”). To qualify for the Prize Drawing, your Entry must be received prior to the end of the Sweepstakes Period. If no entries are received, no prize will be awarded. The Prize Drawing will be conducted on or about June 17, 2019. Only one prize may be awarded to any person. Odds of winning are dependent on the number of Entries received during the Sweepstakes Period.
Prize: One (1) Prize Winner shall be selected following the conclusion of the Sweepstakes Period. Each
winner shall receive a fifty-dollar Hot Dog on a Stick Gift Card. The Prize is non-transferable. Total approximate retail of all prizes is $50.00. No transfer, cash or other substitution of prizes allowed except that Sponsor reserves the right, in its sole discretion, to substitute a prize or prize component of comparable or greater value. Allow six weeks for delivery of prize. Gift certificates may be subject to additional terms and conditions. Sponsor will not replace any lost or stolen prizes once in Winner’s possession. All local, state and federal taxes are the sole responsibility of Winners. All decisions by Sponsor and Administrator as to Winners and prizes, as well as all aspects of the Sweepstakes, are final and binding. Taxes, if any, on prize are the sole responsibility of the winner.
Winner Notification: Sponsors will notify the potential Prize Winner on or about June 18, 2019 by email. The Potential winner is subject to verification by Sponsors whose decisions are final and binding in all matters relating to this Sweepstakes. An entrant is not a winner of any prize regardless of notification unless and until entrant’s eligibility is verified. The verified winner may be posted on Facebook, Instagram, Twitter and the official Hot Dog on a Stick website. If an Entry is found to be ineligible for any reason, does not respond to the e-mail notification within the time frame stated or the prize comes back as undeliverable, the potential winner will be disqualified and will forfeit any rights to the prize and a runner up will be selected as the winner. E-mail notifications will be sent three (3) times and a potential winner must respond no later than 11:59 PM EDT within five days following the last notification to be verified as the Prize Winner. By entering this Sweepstakes, unless prohibited by law, each Entrant grants to the Sweepstakes Entities the right to use, display, distribute or publish such Entrant’s name, likeness, photograph, voice, address (city and state), biographical information, and any material based thereon or derived therefrom, and his/her Entry or to refrain from so doing, in any manner in any and all media, whether now known or hereafter devised, anywhere in the world in perpetuity without limitation or compensation and without additional notice. Acceptance of a prize constitutes a waiver, by Entrant, Identifiable Persons and Third Party Participants, if any, of any claims to compensation, royalties, or other remuneration for all uses of the Entry by Sweepstakes Entities or their respective agents that are permitted or granted hereunder.
General Conditions: This Sweepstakes is intended for viewing in the United States only and shall only be construed and evaluated according to the United States law. You are not authorized to participate in the Sweepstakes if you are not located within the United States. By participating, Entrants (and their parents or legal guardians if Entrants who are minors in the state in which they reside), on their behalf, and on behalf of their respective heirs, executors, administrators, legal representatives, successors and assigns (“Releasing Parties”), (a) agree to be bound by these Official Rules and the decisions of the Sponsors and the judges, which shall be final in all respects, (b) agree that any dispute arising under this Sweepstakes will be governed by, and construed in accordance with, the laws of the State of Georgia, United States of America, without giving effect to any choice of law or conflict of law rules, (c) consent to the jurisdiction and venue of the federal, state, and local courts located in Atlanta, Georgia, (d) agree that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees, (e) agree that under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; and (f) hereby release the Sweepstakes Entities, and each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals’ respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from or in connection with participation in this Sweepstakes and/or acceptance or use of any awarded prize. Entrants agree to indemnify and hold the Released Parties harmless from and against any claims arising out of a breach by Entrant of any of the representation and warranties contained in these Official Rules. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate, garbled or unintelligible entries, communications or documents, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays, inability to upload or download or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by any prize or resulting from the acceptance, possession or use or misuse of such prize, or from participation in the Sweepstakes; or (v) any printing, human typographical, administrative or technological errors in any materials associated with the Sweepstakes. Sponsors disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes, and reserve the right, in their sole discretion, to cancel, modify or suspend the Sweepstakes should a virus, bug, computer problem, unauthorized intervention, human error or other error, corrupt the administration or security of the Sweepstakes. Sponsors shall not be responsible if the Sweepstakes cannot be implemented or if a prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, strikes, governmental action, natural disasters, weather or acts of terrorism. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. ENTRANT (AND THEIR PARENTS OR LEGAL GUARDIANS IF ENTRANTS ARE MINORS) HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, IDENTIFIABLE PERSONS, OR THIRD PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE SWEEPSTAKES WEB SITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
Privacy Policy: All information submitted online by Entrants is subject to, and will be treated in a manner consistent with, Sponsor’s Privacy Policy.
