“STICK OR TREAT” HOT DOG ON A STICK COSTUME CONTEST
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER. THIS IS A SKILL-BASED CONTEST; WINNERS WILL BE SELECTED BY JUDGING AND NOT BY RANDOM DRAWING.
1. SPONSORS
The “Stick or Treat” Hot Dog on a Stick Costume Contest (the “Contest”) is sponsored by Hot Dog on a Stick California Operations LLC, with respect to participating Hot Dog on a Stick locations in California, and Hot Dog on a Stick Operations LLC, with respect to participating Hot Dog on a Stick locations in Hawaii, Utah, New Mexico, and Nevada (collectively, the “Sponsors”).
The Sponsors’ address is 3790 Paradise Road, Suite 250, Las Vegas, Nevada 89169.
2. ELIGIBILITY
The Contest is open only to legal residents of California, Hawaii, Nevada, New Mexico, and Utah who are at least thirteen (13) years of age at the time of entry.
Entrants who are under eighteen (18) years of age, or who are otherwise minors under applicable law, must have the permission of their parent or legal guardian to participate in the Contest and, if selected as a potential winner, to accept the applicable prize.
Employees, officers, directors, and representatives of the Sponsors, their respective parent companies, subsidiaries, affiliates, franchisees, advertising and promotional agencies, and each of their immediate family members and members of their households are not eligible to enter or win.
The Contest is void outside the eligible jurisdictions and where prohibited or restricted by law.
3. CONTEST PERIOD
The Contest will take place on October 31, 2026 (the “Contest Period”), during normal operating hours at participating Hot Dog on a Stick locations.
An entry must be posted to Instagram before the participating Hot Dog on a Stick location where the entrant participated closes on October 31, 2026, based on the local time at that participating location. No purchase is necessary to enter in any eligible state.
All corporate-owned Hot Dog on a Stick locations in California, Hawaii, Nevada, New Mexico, and Utah are participating locations. Franchise locations participate only if specifically designated by the Sponsors as participating locations.

4. HOW TO ENTER
During the Contest Period, an eligible entrant must:
- A. Visit a participating Hot Dog on a Stick location while wearing a Halloween costume;
- i. Take a photograph or video at the participating location during the Contest Period that meets one of the following entry options: Purchase Entry: A photo or video of the entrant with a Hot Dog on a Stick menu item purchased at the participating location; or
- ii. Sign Entry: A photo or video of the entrant in costume with the Hot Dog on a Stick sign at the participating location. No purchase is required for this entry option in any eligible state.
- B. Post the photograph or video to the entrant’s Instagram account;
- C. Tag @HotDogOnAStick in the Instagram post; and
- D. Include the hashtag #StickOrTreatHDOS in the Instagram post.
Entries failing to establish participation during the Contest Period are not eligible and may be disqualified by the Sponsors.
The Instagram account used to enter must be publicly viewable by the Sponsors during the Contest Period and through completion of the judging and winner-verification process.
Only one (1) entry is permitted per person and per Instagram account. In the event an entrant submits more than one entry, only the entrant’s first eligible entry will be considered.
ENTRY REQUIREMENTS
Each entry must be an original photograph or video created by the entrant or submitted by the entrant with all necessary rights and permissions.
By submitting an entry, the entrant represents and warrants that:
- a. the entrant has the right to submit the entry and grant the rights described in these Official Rules;
- b. the entry does not violate or infringe any copyright, trademark, publicity, privacy, or other proprietary or legal right of any third party;
- c. the entrant has obtained any permissions necessary to depict any other identifiable person appearing in the entry;
- d. if a minor is depicted in the entry, the entrant has obtained permission from the minor’s parent or legal guardian to submit and use the entry as contemplated by these Official Rules;
- e. the entry does not contain unlawful, obscene, defamatory, threatening, or otherwise inappropriate material; and
- f. the entry complies with these Official Rules and Instagram’s applicable terms and policies.
Entries that are incomplete, inaccessible, late, fraudulent, misleading, or otherwise fail to comply with these Official Rules may be disqualified.
5. CONTEST CATEGORIES AND PRIZES
Three (3) prizes will be awarded in the following categories:
Best Overall Costume: One (1) $25 Hot Dog on a Stick gift card.
Best Family / Group Costume: One (1) $25 Hot Dog on a Stick gift card.
Best Pet Costume: One (1) $25 Hot Dog on a Stick gift card.
The total approximate retail value of all prizes is $75.
Only the eligible entrant who submits the entry is eligible to receive a prize. A prize awarded for a Family / Group Costume entry will not be divided among members of the family or group.
Each person may win no more than one (1) prize, and each entry may win no more than one (1) Contest category.
Gift cards are subject to their applicable terms and conditions. Prizes are non-transferable and may not be substituted for cash, except that the Sponsors may substitute a prize of equal or greater value if an advertised prize becomes unavailable.
Any taxes or other expenses associated with acceptance or use of a prize are the sole responsibility of the winner.
6. JUDGING
This is a judged, skill-based contest. Winners will not be selected at random.
Eligible entries will be evaluated by a panel of judges selected by the Sponsors based on the following criteria:
- Creativity — 25%. Inventiveness of the costume concept and imaginative use of design, materials, presentation, or theme.
- Originality — 25%. Distinctiveness of the costume and the extent to which it reflects an individual or uncommon interpretation.
- Costume Execution and Visual Impact — 25%. Quality, completeness, coordination, craftsmanship, and overall visual presentation of the costume.
- Halloween Spirit — 25%. Effectiveness in expressing a recognizable Halloween mood, theme, character, humor, or atmosphere.
Each eligible entry will receive a score based on the foregoing criteria. The highest-scoring eligible entry in each category will be selected as the potential winner of that category.
In the event of a tie, the tied entry with the higher Creativity score will prevail. If the entries remain tied, the tied entry with the higher Originality score will prevail. If the entries remain tied thereafter, the panel of judges will determine the winner based on the overall application of the stated judging criteria.
The judges’ decisions are final and binding with respect to the application of the judging criteria, subject to applicable law.
7. FAMILY / GROUP COSTUMES
Only the individual who submits the entry must satisfy the Contest’s eligibility requirements.
Family and group members appearing in an entry do not need to be eligible entrants. The individual submitting the entry is responsible for obtaining all necessary permissions to depict other individuals in the entry.
If any person depicted in a Family / Group Costume entry is a minor, the entrant must obtain permission from that minor’s parent or legal guardian.
8. PET ENTRIES
Only the individual who submits the entry must satisfy the Contest’s eligibility requirements.
The entrant must have the right or permission to submit an entry depicting the pet.
The Sponsors are not responsible for any injury, loss, or damage arising from or relating to participation by any animal.
9. MINORS AND PARENT/GUARDIAN CONSENT
An entrant who is under eighteen (18) years of age, or otherwise a minor under applicable law, represents that the entrant has obtained permission from the entrant’s parent or legal guardian to enter the Contest and to submit the entry.
If a minor is selected as a potential winner, the Sponsors may require the minor’s parent or legal guardian to provide written consent, complete any required winner-verification documents, and accept the prize on the minor’s behalf where required or permitted by law.
The Sponsors may disqualify a potential winner if the Sponsors do not receive satisfactory confirmation of the required parent or legal guardian consent.
10. WINNER SELECTION AND NOTIFICATION
Potential winners will be selected and notified on or before November 13, 2026.
Potential winners will be notified by Instagram direct message to the Instagram account used to submit the winning entry.
A potential winner must respond to the Sponsors’ notification within forty-eight (48) hours after the notification is sent, unless a different period is required by applicable law.
If a potential winner fails to respond within the required time, cannot be contacted, is determined to be ineligible, fails to provide required verification or consent, or otherwise fails to comply with these Official Rules, the Sponsors may disqualify the potential winner and select the next highest-scoring eligible entry in the applicable category.
The Sponsors are not responsible for any failure of an entrant to receive or respond to an Instagram direct message, including as a result of Instagram settings, account restrictions, technical problems, or the entrant’s failure to monitor the account used for entry.
11. LICENSE TO SUBMITTED CONTENT
By submitting an entry, each entrant grants the Sponsors and their respective affiliates a non-exclusive, royalty-free license to reproduce, display, publish, repost, distribute, and otherwise use the submitted photograph or video, together with the entrant’s Instagram handle and first name, in connection with the Contest, the promotion of the Contest, the announcement of Contest winners, and the promotion of Hot Dog on a Stick.
This license includes the right to repost or display the entry on Hot Dog on a Stick and the Sponsors’ websites and socialmedia accounts.
The foregoing license does not transfer ownership of the entry to the Sponsors.
12. GENERAL CONDITIONS
The Sponsors reserve the right to disqualify any entrant who tampers with the entry process, attempts to manipulate or interfere with the Contest, submits fraudulent or misleading information, violates these Official Rules, or acts in a manner intended to disrupt the legitimate operation of the Contest.
The Sponsors reserve the right, subject to applicable law, to modify, suspend, or terminate the Contest if fraud, technical failure, unauthorized intervention, or another circumstance beyond the Sponsors’ reasonable control materially affects the integrity or administration of the Contest.
The Sponsors are not responsible for lost, late, incomplete, inaccessible, misdirected, deleted, or improperly submitted entries; Instagram outages or restrictions; technical or network failures; or any other circumstances that prevent an otherwise eligible entry from being received or reviewed.
13. RELEASE AND LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, by participating in the Contest, each entrant agrees to release and hold harmless the Sponsors and their respective parent companies, subsidiaries, affiliates, franchisees, advertising and promotional agencies, and each of their respective officers, directors, employees, representatives, and agents from any and all claims, liabilities, losses, damages, costs, and expenses arising out of or relating to participation in the Contest or acceptance, possession, use, or misuse of any prize, except to the extent such release is prohibited by applicable law.
Nothing in these Official Rules limits or excludes liability that cannot lawfully be limited or excluded.
14. INSTAGRAM DISCLAIMER
This Contest is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc.
By participating in the Contest, each entrant acknowledges and agrees that the information provided in connection with the Contest is being provided to the Sponsors and not to Instagram or Meta Platforms, Inc.
Each entrant further agrees to release Instagram and Meta Platforms, Inc. from any claims arising out of or relating to the Contest, to the extent permitted by applicable law.
15. PRIVACY
Personal information collected from entrants in connection with the Contest will be used for purposes of administering the Contest, verifying eligibility, communicating with entrants, awarding prizes, and otherwise as described in the Sponsors’ applicable privacy policy.

16. GOVERNING LAW
These Official Rules and any disputes arising out of or relating to the Contest shall be governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles, except to the extent that applicable law in an entrant’s state of residence or another applicable jurisdiction cannot lawfully be waived or displaced.
Before commencing a formal proceeding, the entrant and the applicable Sponsor will attempt in good faith for at least thirty (30) days to resolve the dispute informally after one party provides the other with written notice describing the dispute and requested relief.
Except to the extent prohibited by applicable law, any judicial action arising out of or relating to the Contest must be brought exclusively in a state or federal court of competent jurisdiction located in Clark County, Nevada, and each party consents to the personal jurisdiction of those courts. Each claim must be brought in the claimant’s individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding, except where that restriction is prohibited by applicable law.
To the fullest extent permitted by law, recovery in any dispute will be limited to actual out-of-pocket costs directly incurred in entering the Contest, and no party will be entitled to punitive, exemplary, special, incidental, consequential, or indirect damages or attorneys’ fees, except where such limitation is prohibited by applicable law.
17. SEVERABILITY; INTERPRETATION
If any provision of these Official Rules is held invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect. The Sponsors’ failure to enforce any provision does not waive that provision.
Headings are for convenience only and do not affect interpretation. If Contest advertising or promotional material conflicts with these Official Rules, these Official Rules control. The term “including” means “including without limitation.”
18. WINNERS LIST
The names of the Contest winners will be available on social media after the winners have been verified.
